GOINGTODR – RENTAL TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) apply to reservations made through GoingToDR and to the guest’s occupancy and use of the reserved property.

By making a reservation, submitting payment, checking a box accepting these Terms, or occupying the property, the person making the reservation (“Guest”) acknowledges that they have read, understood, and agreed to these Terms.

1. ROLE OF GOINGTODR AND PROPERTY OWNER

GoingToDR provides property management, reservation, booking, and related services for independently owned properties.

Unless expressly stated otherwise, GoingToDR is not the owner of the rental property.

The property owner (“Property Owner”) owns or controls the property being rented, while GoingToDR may act as the Property Owner’s property manager, booking representative, or authorized agent.

Nothing in these Terms shall be interpreted as making GoingToDR the owner of a property that it does not own.

2. RESERVATIONS AND PAYMENTS

The Guest is responsible for reviewing all reservation details, including the property selected, dates, number of guests, rental price, fees, payment requirements, and applicable house rules before confirming a reservation.

All required payments must be made according to the payment instructions provided for the reservation.

Any remaining balance must be paid in the manner and currency specified in the reservation instructions.

Failure to make a required payment when due may result in cancellation or termination of the reservation, subject to applicable law.

3. NON-REFUNDABLE PAYMENTS

Except where otherwise expressly stated in writing by GoingToDR or where a refund is required by applicable law, payments made toward a reservation are non-refundable.

This includes deposits, reservation payments, partial payments, and other amounts designated as non-refundable at the time of booking.

A Guest's decision to cancel, failure to arrive, late arrival, early departure, change of travel plans, or failure of a member of the Guest's party to travel does not automatically create a right to a refund.

Any exception must be authorized in writing by GoingToDR or otherwise required by applicable law.

4. PROPERTY DAMAGE AND REIMBURSEMENT

The Guest is financially responsible for damage, destruction, breakage, loss, theft, excessive cleaning, or other harm to the property or its contents caused by the Guest or by any person, child, visitor, invitee, or other individual permitted onto the property by the Guest.

This responsibility may include, as applicable:

Furniture

Appliances

Televisions and electronics

Air-conditioning equipment

Doors and windows

Locks and keys

Linens and towels

Kitchen equipment

Decorations and furnishings

Plumbing fixtures

Walls and flooring

Outdoor areas

Common areas

Missing property

Excessive cleaning

Smoke-related cleaning

Other property belonging to the Property Owner

If an item is damaged but can reasonably be repaired, the Guest may be responsible for the reasonable repair cost.

If an item is lost, destroyed, stolen, or cannot reasonably be repaired, the Guest may be responsible for the reasonable replacement cost.

The Guest agrees to reimburse the Property Owner and/or GoingToDR, as applicable, for valid and documented amounts for which the Guest is responsible.

5. REPORTING DAMAGE

The Guest must promptly report any significant damage, malfunction, dangerous condition, accident, or breakage discovered or occurring during the stay.

Reporting damage does not by itself relieve the Guest of financial responsibility when the Guest or someone for whom the Guest is responsible caused the damage.

GoingToDR or the Property Owner may document damage using photographs, video, invoices, repair estimates, receipts, inspection reports, or other reasonable evidence.

6. GUEST INSURANCE REQUIREMENT

As a condition of booking, the Guest represents and confirms that the Guest maintains appropriate travel, vacation-rental, or other insurance suitable for the Guest's trip and circumstances.

Guests are responsible for obtaining coverage appropriate to their needs, which should include, where available and applicable:

Accidental property damage

Trip cancellation or interruption

Personal belongings

Medical emergencies

Accidents and injuries

Other travel-related risks

GoingToDR and the Property Owner do not provide travel insurance, rental insurance, medical insurance, or personal-property insurance to Guests unless expressly stated otherwise in writing.

GoingToDR does not undertake a duty to verify the existence, validity, limits, exclusions, or sufficiency of a Guest's insurance.

Unless specifically requested, the Guest is not required to submit proof of insurance to GoingToDR.

By accepting these Terms and completing the reservation, the Guest represents that the Guest has satisfied this insurance requirement.

7. INSURANCE DOES NOT ELIMINATE GUEST RESPONSIBILITY

The existence or absence of insurance does not automatically eliminate a Guest's responsibility for damage, loss, costs, or other amounts for which the Guest is legally or contractually responsible.

The Guest remains responsible for amounts properly owed under these Terms regardless of whether the Guest's insurer approves or denies a claim, subject to applicable law.

8. PERSONAL BELONGINGS

Guests are responsible for safeguarding their money, passports, identification, jewelry, electronics, luggage, vehicles, and other personal belongings.

GoingToDR and the Property Owner do not act as insurers of Guest property.

Any responsibility of GoingToDR or the Property Owner for lost, stolen, or damaged Guest property will be determined in accordance with applicable law.

9. ACCIDENTS, INJURIES, AND ASSUMPTION OF ORDINARY RISKS

Guests are responsible for exercising reasonable care while using the property and its amenities.

Guests acknowledge that ordinary risks may be associated with travel and the use of a residence, including wet floors, stairs, balconies, kitchens, bathrooms, outdoor areas, pools where applicable, and other ordinary residential features.

Guests must supervise children and other persons requiring supervision.

To the fullest extent permitted by applicable law, each Guest accepts responsibility for injuries or losses resulting from the Guest's own acts, omissions, negligence, misuse of the property, violation of house rules, or other conduct for which the Guest is legally responsible.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

10. VISITORS AND ADDITIONAL GUESTS

The person making the reservation is responsible for the conduct of individuals whom that Guest invites, permits, or provides access to the property, to the extent permitted by applicable law.

The maximum occupancy stated for the property must be respected.

Unauthorized parties, events, or additional overnight occupants are prohibited unless approved by GoingToDR or the Property Owner.

The Guest may be financially responsible for damage, additional charges, fines, excessive cleaning, or other losses resulting from unauthorized visitors or activities for which the Guest is responsible.

11. CHILDREN AND MINORS

Parents, guardians, and responsible adults are responsible for supervising minors at all times.

Neither GoingToDR nor the Property Owner provides childcare or supervision.

The Guest making the reservation is responsible for ensuring that minors in the Guest's party comply with applicable property rules.

12. HOUSE RULES

Guests must comply with all property-specific house rules provided before or during the stay.

House rules may address matters including:

Occupancy

Noise

Smoking

Pets

Visitors

Parties and events

Parking

Building or condominium rules

Pools and common areas

Security

Check-in and checkout

Garbage disposal

Utilities

Restricted areas

Material or repeated violations may result in appropriate action, including termination of the stay where legally permitted.

Any refund following termination will be determined by these Terms, the applicable reservation policy, and applicable law.

13. CONDOMINIUM, COMMUNITY, AND BUILDING RULES

Where a property is located within a condominium, residential community, gated development, or other regulated building, Guests must comply with applicable community and building rules.

Guests may be responsible, to the extent permitted by law, for fines, penalties, damage, or costs resulting from violations caused by the Guest or persons for whom the Guest is responsible.

14. ILLEGAL AND DANGEROUS ACTIVITY

The property may not be used for unlawful purposes or activities that create an unreasonable danger to persons or property.

GoingToDR and/or the Property Owner may contact building security, emergency services, or appropriate authorities when reasonably necessary to protect persons or property or comply with law.

15. SMOKING, PETS, PARTIES, AND EVENTS

Smoking, pets, parties, and events are permitted only when expressly allowed by the property's listing or authorized in writing.

Where prohibited, the Guest may be responsible for reasonable cleaning, repair, deodorizing, remediation, fines, or other documented costs caused by a violation.

16. UTILITIES AND SERVICES

Temporary interruptions of electricity, water, internet, telecommunications, air conditioning, building services, or other utilities may occasionally occur.

Guests must promptly notify GoingToDR of significant service problems so that reasonable efforts can be made to investigate or address them.

Any Guest rights or remedies concerning service interruptions remain subject to applicable law.

17. PROPERTY ACCESS

Where reasonably necessary and permitted by applicable law, the Property Owner, GoingToDR, maintenance personnel, building management, or authorized contractors may access the property for emergencies, necessary repairs, maintenance, safety concerns, inspections related to reported problems, or other legitimate property-management purposes.

Except in emergencies or where circumstances make advance notice impracticable, reasonable efforts will be made to provide appropriate notice.

18. FALSE OR MISLEADING INFORMATION

Guests must provide accurate information when making a reservation.

A reservation may be refused or terminated, where permitted by law, if it was obtained through fraud, material misrepresentation, false identification, unauthorized payment information, or deliberate concealment of material reservation information.

19. COLLECTION OF AMOUNTS OWED

If a Guest fails to pay a valid amount owed under these Terms, GoingToDR and/or the Property Owner may pursue lawful collection remedies.

The Guest may be responsible for reasonable collection costs, court costs, and attorneys' fees incurred in enforcing these Terms, but only to the extent such recovery is permitted by applicable law and awarded or otherwise legally recoverable.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, GoingToDR and the Property Owner will not be responsible for losses caused solely by a Guest's own negligence, intentional misconduct, violation of these Terms, unlawful activity, or misuse of the property.

Nothing in these Terms excludes, waives, or limits any liability that cannot lawfully be excluded, waived, or limited under applicable law.

21. EVENTS OUTSIDE REASONABLE CONTROL

Circumstances outside the reasonable control of GoingToDR or the Property Owner may include hurricanes, tropical storms, earthquakes, floods, government actions, civil disturbances, widespread utility failures, transportation interruptions, public emergencies, and other extraordinary events.

The rights and obligations of the parties following such an event will be determined by the reservation terms and applicable law.

22. APPLICABLE LAW

For rental properties located in the Dominican Republic, these Terms and the rental relationship are subject to applicable laws and mandatory legal protections of the Dominican Republic.

Nothing in these Terms is intended to waive any consumer or other legal right that cannot lawfully be waived.

23. SEVERABILITY

If a court or competent authority determines that any provision of these Terms is invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where appropriate.

The remaining provisions will continue in effect to the extent permitted by law.

24. PROPERTY-SPECIFIC TERMS

Individual properties may have additional rules, restrictions, fees, cancellation provisions, security requirements, or other conditions.

Where properly disclosed and legally enforceable, those property-specific terms form part of the Guest's agreement.

25. ELECTRONIC ACCEPTANCE

By checking the box accepting these Terms, submitting a reservation, making payment after being presented with these Terms, or otherwise electronically accepting them, the Guest confirms that the Guest has had an opportunity to review these Terms and agrees to be bound by them.

Electronic acceptance is intended to constitute acceptance of the agreement to the extent permitted by applicable law.

26. ENTIRE AGREEMENT

These Terms, together with the reservation confirmation, property-specific rules, disclosed cancellation policy, and other terms expressly incorporated into the reservation, constitute the agreement governing the reservation.
